Atlas Intelligence provides done-for-you business automation services built on the GoHighLevel platform. Our services may include, but are not limited to:

• AI receptionist and automated messaging systems
• Missed call text-back automation
• Lead follow-up and CRM pipeline management
• Online booking and calendar automation
• Google review request automation
• Website design, hosting, and local SEO
• Business directory listing management

2. Subscription and Billing

Our services are offered on a month-to-month subscription basis. By subscribing, you agree to the following:

• No contracts. You may cancel your subscription at any time without penalty.
• Monthly fees are billed in advance at the start of each billing cycle.
• Cancellations must be submitted at least 48 hours before the next billing date to avoid the next charge.
• We reserve the right to modify pricing with 30 days advance notice.
• No refunds are issued for partial months of service.

3. SMS Messaging and Communications

As part of our services, we operate automated SMS and messaging systems on your behalf. By using our services, you acknowledge and agree that:

• You are solely responsible for ensuring all contacts in your system have provided proper consent to receive automated messages.
• You will comply with all applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all carrier guidelines.
• You will not use our platform to send spam, unsolicited messages, or communications that violate any law or regulation.
• You will maintain proper opt-out mechanisms and honor all STOP requests immediately.
• Message and data rates may apply to end recipients.

We are not liable for any penalties, fines, or legal action resulting from your failure to comply with messaging laws and regulations.

4. Client Responsibilities

You are responsible for:

• Providing accurate business information required to set up your system
• Ensuring all customer data you provide complies with applicable privacy laws
• Maintaining accurate and up-to-date contact lists
• Reviewing and approving automated message content before deployment
• Notifying us promptly of any changes to your business information
• Complying with all applicable local, state, and federal laws

5. Acceptable Use

You agree not to use our services to:

• Send spam or unsolicited commercial messages
• Harass, threaten, or harm individuals
• Engage in any fraudulent or deceptive practices
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Collect or harvest personal data without proper consent

We reserve the right to suspend or terminate your account immediately if we determine you have violated these terms.

6. Intellectual Property

All content, systems, workflows, and materials created by Atlas Intelligence remain the intellectual property of Atlas Intelligence. Upon full payment of all fees, you receive a limited, non-transferable license to use the configured system for your business during the active subscription period.

You retain ownership of your business data, customer contact lists, and content you provide to us.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability to you for any claims arising from these Terms or our services shall not exceed the total amount paid by you in the three months preceding the claim.

8. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or that specific results will be achieved. Results vary by business, industry, market conditions, and other factors outside our control.

9. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the automation system will be suspended at the end of the current billing period
• You may request an export of your business data within 30 days of termination
• Any outstanding balances remain due and payable

We may terminate your account immediately for violations of these Terms without refund.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Erie County, New York.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days notice of material changes via email or posting on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
